
Changes in tax legislation from March 2025: what businesses need to know
April 11, 2025As part of the changes in migration legislation that came into force in July 2024, foreign citizens who are not residents of the countries of the Eurasian Economic Union (EAEU) are required to obtain a temporary residence permit marked “business” in order to conduct business in the territory of the Republic of Kazakhstan.
This procedure is an integral stage of preparation for the state registration of a legal entity (in particular, a limited liability partnership — LLP) and is aimed at legalizing the status of a foreign investor or founder of a company.
The legal significance of a business PRTR
A business permit is an official permit for temporary residence in Kazakhstan for the purpose of carrying out entrepreneurial activities. It grants the right:
for the legal registration of a legal entity;
to obtain the appropriate visas and permits;
to participate in banking, tax and other business-related legal procedures;
for a subsequent extension of the stay, if necessary.
List of required documents
To apply for a business loan, the applicant must provide the following set of documents:
Certificate of absence of criminal record;
A certificate confirming the absence of a ban on doing business in the state of citizenship/permanent residence;
Foreign passport;
Individual Identification Number (IIN) issued in the Republic of Kazakhstan;
Notarized consent of the landlord for temporary residence of the applicant;
Certificate of fingerprint registration;
Medical certificate form 028/y;
Medical insurance, which includes coverage for emergency care and specialized treatment.
Note: The first two documents must be issued in the country of citizenship before entering Kazakhstan. All others are registered directly on the territory of the Republic of Kazakhstan.
Application procedure
The procedure for registration of a business loan does not require the personal participation of a foreign citizen at the time of application. The documents can be submitted by the owner of the residential premises at which the registration of the residence is planned. However, the submission requires the presentation of the applicant’s original passport to the Public Service Center (PSC).
If you have a complete set of documents, the deadline for completing a business loan is from one to three business days.
Legal significance and support
Obtaining a business permit is a prerequisite for the legal registration of an LLP and the subsequent conduct of business by a foreign citizen. Failure to comply with legal requirements will result in the inability to register a legal entity and may result in administrative liability.
